Last Day to Give Notice in Person
September 30, 2016
Today is the last day of the month, which means it’s your last chance to give written notice to end your month-to-month tenancy for the last day of next month.
The Residential Tenancy Act has rules about when communication is considered received by another party:
|Form of Delivery||Received|
|Delivering it in person||same day|
|Leaving it in a mail slot or mail box||3 days later|
|Faxing it||3 days later|
|Posting it on a door or other obvious place||3 days later|
|Sending it registered or regular mail||5 days later|
This means that you should give your landlord written notice in person. If that’s not possible and you have to deliver your notice in another manner, try to gather evidence that your landlord received your notice today. For example, if you post your notice on their door and then receive email verification that they received your notice today, the “3-days-later” rule may not apply.
