If you have a month-to-month tenancy agreement, today is the last day to post your one month written notice on your landlord’s door to end your tenancy for the last day of next month. Today is also the last day to fax your notice, or leave it in a mail slot or mailbox.
The Residential Tenancy Act has rules about when communication is considered received by another party:
|Form of Delivery||Received|
|Delivering it in person||same day|
|Leaving it in a mail slot or mail box||3 days later|
|Faxing it||3 days later|
|Posting it on a door or other obvious place||3 days later|
|Sending it registered or regular mail||5 days later|
To protect yourself, always try to have evidence of how you gave your notice.
If you are unable to give your notice today, you may need to serve it in person before the end of the month.
If you have a fixed-term tenancy agreement rather than a month-to-month tenancy agreement, moving out can be a little more complicated. See TRAC’s webpage on Moving Out for more information.
